Privacy Statement Effective Date: April 2010

Collection of Non-Public Personal Information. As part of our operating procedures in
offering prescription related services, BeyondRx needs to obtain information for the
enrollment and maintenance of member participation (eligibility) in our system, the
payment of prescription drugs and related services and the healthcare operations of client
health plans. In providing these services, BeyondRx and its personnel or agents may collect
nonpublic personal information (which includes both nonpublic personal and health
information about our members) such as:

  • Member Name
  • Addresses
  • Telephone Numbers
  • Email Addresses
  • Health Information
  • Prescription History List
  • Physician Names

Workforce Access to Information. Internally, BeyondRx limits access to members'
information to those employees and workforce members who need the information to
perform their job functions. Employees and workforce members who misuse information
are subject to disciplinary action or termination.

Use of Information. BeyondRx uses or shares your health information only for the
purposes of performing functions related to payment for your prescription drugs and related
services and your health plan’s healthcare operations. BeyondRx also uses and shares your
nonpublic personal information in accordance with your consent or as required or permitted
by law. BeyondRx does not sell, rent, lease or otherwise disclose members’ personal
information for purposes unrelated to our products and services.

Disclosure of Information to Other Persons. BeyondRx may disclose your nonpublic
personal prescription information to consultants, agents, brokers, third party administrators,
plan benefit managers or other parties who perform services for us or your health plan and
to pharmacists and physicians that provide professional services to you and your household
members. We also may disclose your nonpublic prescription information to other third
parties as authorized by you, or as required or permitted by law.

Disclosures Required by Law. In certain circumstances, BeyondRx may be legally
compelled to release your nonpublic personal information in response to a court or
administrative order, subpoena, search warrant, law or regulation.

Safeguarding Information. BeyondRx safeguards and secures members’ nonpublic
personal information that we collect, receive or maintain. We maintain administrative,
technical and physical safeguards to ensure the security and confidentiality of our members’
health information, to protect against anticipated threats or hazards to such information,
and to protect against unauthorized access to or use of such information. BeyondRx utilizes
commercial firewalls and router access control lists at public network access points to
appropriately restrict network traffic and uses a secure socket layer (“SSL”) protocol for all
outgoing transmissions. Our network address space, where nonpublic personal information
is stored and protected, is not advertised to the internet, and outside requests for
information are blocked. A user must be properly authenticated with the appropriate access
credentials to access sensitive information.

“Members Only” Section. Our website includes a “members only” section. This Section
may allow you, as an adult member, access to the prescription drug utilization of other
members in your household and under 18 years of age. When registering to use the
“members only” section, you may elect to view the prescription utilization for any such
other household members. To view the prescription utilization, you must certify that permission has been obtained from them and agree to use their prescription utilization
information solely for the purposes of prescription benefit management. You also must
agree not to use any adult dependant's prescription history for any other purpose without
the written consent of that dependent. BEYONDRX DISCLAIMS ALL PRESENT AND FUTURE LIABILITY FOR ANY USE BY A MEMBER OR YOU OF ANOTHER HOUSEHOLD MEMBER’S NON-PUBLIC PERSONAL INFORMATION THAT IS BEYOND THE SCOPE OF THE MEMBER’S CERTIFICATION AND AGREEMENT.

Website Collection and Use of Information. BeyondRx may use your nonpublic
personal information to create non-identifying data for the purpose of analyzing site usage
related to our website. When you visit our website, BeyondRx may collect information from
you, such as the internet browser and the computer operating system you are using and
your IP address when you request pages from the website host server. BeyondRx also may
store a text file (“cookie”) on your computer. BeyondRx reserves the right to aggregate this
data with data on the pages visited by other users to track overall visitor traffic patterns, to
provide better website connections and to improve the BeyondRx website. BeyondRx
considers the information obtained through our website to be a significant asset of its
business. If BeyondRx is sold, merges with another entity, becomes insolvent or declares
bankruptcy, the website, and any information obtained through the website, may be
transferred or sold to another entity, in accordance with applicable law.

Website Information Practices Related to Children. Our website is not intended or
designed to attract users who are under the age of 18. BeyondRx is committed to
preventing the unintentional collection of nonpublic personal information from children
under the age of 13. Any nonpublic personal information of a child under 13 that is
provided to us must be provided by the registered adult member and not by a child under
the age of 13 who is using our website. If you are the parent or legal guardian of a child
under the age of 13 whom you have reason to believe has provided his or her own personal
information directly to BeyondRx, you have the right to review, and have deleted, that
child's personal information from our website database. To request the removal of that

Other Websites. BeyondRx's website may include links to other websites that are not
related to or are not owned by BeyondRx. BeyondRx is not responsible for the
dependability or information security of those websites, and this Privacy Statement applies
only to the BeyondRx website.

Changes to Our Privacy Statement. BeyondRx reserves the right to change this Privacy
Statement at any time and without advance notice to you. Changes to this Statement will
be prominently posted at the top of this page, along with a reference to the updated
effective date. In addition, you will receive notice of the changes when you sign in.
Announcements of Privacy Statement changes will include guidelines, if applicable, to reject
the additional use, disclosure or sale of your information.
